•   Participants must be twenty one years (21) old or over and only Singapore Citizens and Permanent Residents are allowed to participate. Proof of age and citizenship may be required.

 

• By submitting the Registration Form, the Applicant and agrees to be bound by the Terms and Conditions

 

• Submissions that do not comply with the Submission Requirements will be disqualified.

 

• The decision of the Organiser on the selection of participants is final and binding.

 

 

1. DEFINITIONS

 

1.1 In this General Terms and Conditions, unless the context otherwise requires, the following terms and expressions shall

     have the following meanings:

 

Applicant                    the individual who has applied to participate in the Masterclass

 

Assignment                the assignment required by successful Applicants to submit after the end of the Masterclass

 

Course                        any other related programme in relation to the Masterclass, organised by the Organiser

 

Masterclass                the 4-day mm2 Chinese Scriptwriting Masterclass organized by mm2 Entertainment.

Parties                        the Organiser and the Applicant, “Party” means any of them

 

 

 

2. UNDERTAKINGS BY APPLICANTS

 

2.1 The Applicant hereby agrees and undertakes as follows:

 

(a) all information provided in respect of the Masterclass (including all information relating to his/her personal particulars,

      career details etc) is complete, true and accurate;

 

(b) he/she satisfies all applicable eligibility criteria for the Masterclass

 

(c)  that he/she shall fully comply and observe these General Terms and Conditions. The Applicant agrees that the aforesaid

      terms and conditions may be amended and/or varied by the Organiserfrom time to time and shall apply to the Trainee

      upon such amendment and/or variation

 

(d) that he/she shall conduct himself/herself in a responsible, competent and professional manner at all times. The

      Applicant shall not in any way, intentionally, without valid reason, render himself/herself unable or unsuitable to pursue 

      the Masterclass

 

(e) that he/she shall observe and abide by the applicable rules and regulations imposed at the venue(s) that the Masterclass

      or any part thereof is conducted.

 

(f) that he/she shall be responsible for the proper use and maintenance of all property and facilities belonging to the

      Organiser or any other party for whose premises or facilities are being used for the Masterclass or any part thereof. The

      Applicant shall be responsible for any misue of the premises, the property and/or facilities, and for any lsos or damage

      thereto.

 

(g) that he/she shall attend not less than 50% of the Masterclass. Failure to achieve the minimum attendance requirement

      may render the Applicant ineligible to receive a certificate of attendance and to refund the Organiser the Course Fee. 

 

 

(h) that he/she consents to the Organiser making audio and/or audio visual recordings and/or taking photographs of the

      Applicant in respect of his/her participation in the Masterclass and all related or ancillary activities, and further consents

      and agrees to such recordings and/or photographs being used by the Organiser for its publicity and promotional

      purposes;

 

(i) that he/she shall not, and shall not permit any other person to use or reproduce any content or material (whether in

      whole or in part) provided to the Applicant in respect of the Masterclass without prior written consent of the Organiser

      

 

(j) that he/she shall participate in any survey conducted by the Organiser relating to the Masterclass and submit all

      assignments given out as part of the Masterclass

 

 

2.2 The Applicant further agrees that:-

 

(a) the Organiser shall have the discretion to determine all matters relating to the Masterclass, and the Applicant shall accept

      and abide by all decisions made in relation thereto. In particular, and without prejudice to the foregoing, the Organiser

      have the right to change or vary the Masterclass curriculum and/or the schedule and/or venue; and

 

(b) the Organiser shall have the right to deny entry to and/or to remove the Applicant from the Masterclass, or from any      

      venue(s) that the Masterclass or any part thereof is conducted as the Organiser may reasonably deem fit. Without

      prejudice to the foregoing, circumstances under which the Organiser may exercise such discretion include, without

      limitation, where the Applicant may have contracted any infectious disease, or if the Applicant’s presence or behavior is

      unduly disruptive to the proper conduct of the Masterclass

 

 

 

3. COURSE FEES

 

3.1 The Masterclass is valued at $1,150 and is 100% subsidized by the Organiser and will cover venue rental,

      speakers’ fees and course materials produced solely for the Masterclass. Any additional materials required by the

      Applicant are not included and shall be bourne by the Applicant.

 

 

 

4. INDEMNITY

 

4.1 The Applicant shall indemnify and keep the Organiser and/or any of their respective subsidiaries, affiliates, licensees,

      agents, employees and assignees, harmless from and against any claims, damages, costs, judgments, losses or expenses

      (including reasonable legal fees on an indemnity basis) which may be sustained or suffered by or secured against the

      Organiser and/or any of their respective subsidiaries, affiliates, assignees, licensees, agents, officers, directors or

      employees arising out of any breach by the Applicant of any of its covenants, representations, warranties or agreements

      contained in this Agreement, or arising from this Agreement.

 

4.2 To the extent permitted by law, the Organiser shall be under no liability whatsoever to the Applicant or his/her personal

      representatives in respect of any loss, damage or injury to life or property howsoever occurring. For the avoidance of

      doubt, the Organiser shall at no time be responsible to the Applicant for any grants, disbursements and/or allowances

      due from any other party.

 

 

 

5. WARRANTIES

 

5.1 The Applicant warrants that he/she am the sole owner and creator of the Assignment to be submitted and he/she has the

      full power and authority to make this Agreement; that this Assignment will not not infringe any copyright, violate any

      property rights, or contain any scandalous,libelous, or unlawful matter. The Applicant will defend, indemnify and hold

      harmless the Organiser and/or its licensees and related companies against all claims, suits, costs, damages and expenses

      that the Organiser may sustain by reason of any scandalous, libellous, or unlawful matter contained or alleged to be

      contained in the Assignment or any infringement or violation by the Assignment of any copyright, patent or other

      intellectual property right; and unless such claim or suit has been settled or withdrawn, the Organiser may terminate this

      Agreement with the Applicant.

 

 

 

6. INTELLECTUAL PROPERTY RIGHTS

 

6.1 The Organiser shall own all intellectual property rights, including all copyright, goodwill and all other rights in respect of

      all content used as training materials in the process of organising the Masterclass (except for selected materials licensed

      from third parties.

 

6.2 All intellectual property rights of all other works performed or created pursuant to or in the course of this Agreement and

      over the course of the Masterclass by the Applicant shall belong to the Applicant

 

6.3 The Applicant agrees and undertakes that he/she shall not, and shall not permit any other person, to use or reproduce

      any content or material (whether in whole or in part) provided to the Applicant in respect of the Masterclass without the

      prior written consent of the Organiser.

 

6.4 This Clause 6 shall survive the expiry or termination of this Agreement.

 

 

 

7. CONFIDENTIALITY

 

7.1 Any confidential information acquired or obtained by the Trainee in the course of the Masterclass or in relation to this

     Agreement shall be kept confidential, and the Trainee shall not use or disclose such confidential information to any third

     party without the prior written consent of the Organiser. This confidential provision shall survive the termination or

     expiration of this Agreement.

 

 

 

8. TERMINATION

 

8.1 The Organiser may forthwith terminate this Agreement by written notice to the Applicant in any of the following events:

 

(a) if the Applicant is in breach, or refuses, neglects or fails to comply with any terms and conditions herein.

 

(b) if the Organiser is reasonably satisfied that the Applicant is guilty of any misconduct to render him/her not suitable to

      continue with the Masterclass; or

 

(c) for such other reason as the Organiser may in its sole discretion decide.

 

8.2 In event of termination, the Applicant shall forthwith cease to be allowed to participate in the Masterclass or any activities

      in relation thereto and shall be liable to the Organiser for all the relevant costs incurred in relation the Trainee’s

      participation in the Masterclass, Provided always that such termination shall be without prejudice to any other rights and

      remedies of the Organiser at law and/or in equity.

 

 

 

9. APPLICANT’S DECLARATION

 

9.1 I declare that all the information contained in the Registration Form is true and correct and given of my own free will. I

      expressly authorise the Organiser to provide any information disclosed in the Registration Form to any party for any

      purpose in connection with the Masterclass. I acknowledge and agree that if I am found to have deliberately provided any

      false information in the Registration Form or the supporting documents at any time, the Organiser may terminate my

      enrolment in the Masterclass.

 

9.2 I understand and agree that the Organiser can use my particulars above to contact me for any purpose in connection

      with the Masterclass I have applied for.

 

9.3 A failure to complete the Masterclass shall be defined as any of the following:

• Leaving the Masterclass, either through withdrawal from of your own accord of termination of your Masterclass enrolment by the Organiser for any reason, or

• Failure to achieve 50% attendance rate and/or failure to be assessed for any of the Masterclass

 

9.4 I agree to participate in any survey administered by the Organiser and/or any party for any purpose in connection with

      the Masterclass

 

9.5 I confirm that I have read, understood and agree that I accept and shall be bound by the Terms and Conditions as stated

      above an those Terms and Conditions are incorporated by reference in the Registration Form.

 

9.6 FOR APPLICANTS WITH OTHER EMPLOYMENT AGREEMENTS AND/OR ANY AGREEMENTS WITH CONFLICT OF

      INTEREST TO THIS AGREEMENT, I confirm that I have obtained clearance from the company or companies or any

      other party, I have entered into an agreement with, to enrol into this Masterclass and enter into this Agreement with the

      Organiser and shall therefore comply with all terms and conditions listed.

 

9.7 I acknowledge that there is to be an Assignment at the end of the Masterclass and that this Assignment shall reviewed by

      the Organiser and is subject to selection for other Courses, and if selected, shall be bound by a separate Agreement to be

      agreed by both Parties. 

 

Your personal data submitted under the Registration Form may be used to send you notices, information, promotions and updates including marketing and advertising materials in relation to goods and services of the Organiser, the mm2 Group of Companies and its business partners, and for research and analysis.
